Terms & Conditions

Please read these terms and conditions carefully and ensure you fully understand them prior to establishing a reservation or booking with The Celebration Company (ABN 73 156 645 626) trading as The Celebration Travel Company (“we” or “us”).  A copy of these Terms & Conditions will be provided at the time of making your booking, as well as additional Terms & Conditions for service providers pertinent to your itinerary. Upon paying a deposit to us for your travel arrangements, we ask you to sign and send us a copy acknowledging that you understand and agree with those Terms and Conditions.  If booking through a travel agent, a copy of the Terms & Conditions is also provided to your travel agent at time of confirmation, prior to monies being received by us.  Your travel agent will request you read and sign a copy of our Terms in addition to their own agency’s Terms.

Responsibility, Liability, and Governing Law

The Celebration Travel Company puts together holiday packages but we are not a transport, tour, event, or accommodation provider.  We make travel bookings on your behalf.  We only act as an agent and co-ordinator for those service providers, from whom we may receive fees, commissions, gifts or financial incentives.  We also receive bookings from travel agents in our capacity as an international wholesaler and the same conditions apply.  All bookings are made subject to the terms and conditions, including conditions of carriage and limitations of liability imposed by those service providers, and are subject to the laws of the country where the services are provided.  We are not responsible for the inability to earn or redeem loyalty points from any service provider on your itinerary.

To the extent permitted by law neither The Celebration Travel Company, nor any of its related bodies corporate, directors, employees or agents, accept liability or any claim for compensation for any damage, loss,  injury, delays, additional expenses or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure, or any other events which are outside the control of the company.  Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law).  This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010.

Should any dispute arise between you and us, the laws of Australia will apply in the jurisdiction of Queensland.

Brochures and website content, descriptions, maps and photographs

Hotel, resort, cruise vessel, activity, and meal descriptions are based on information provided to us by the supplier of the service.  The Celebration Travel Company has exercised reasonable care to ensure the content of its website (www.celebrationtravelcompany.com.au) and brochures are accurate and up to date based on detailed information regarding services and facilities provided to us by the supplier or other third parties at time of publication. Whilst every effort is made to ensure the accuracy and currency of the information provided on our website and in our brochures, errors or omissions may occur.  The Celebration Travel Company disclaims all liability to any party for loss or damage resulting from such errors or omissions. Additionally, services and facilities may change at any time after the date of publishing or printing content.   You should ask your consultant if there are any changes to the published information of which they may be aware prior to making your booking.  The contact information you provide at time of booking will be used to contact you should we be made aware of any changes to facilities and services by the supplier or other third parties associated with your travel arrangements.  Maps and photographs are for general reference and are an indication only.  Hotel room or cabin photos are representative only, provided by the hotel or cruise vessel supplier, and may not be of the actual room occupied.  Décor, inclusions and room layouts may vary.

Prices

Prices shown on our website, in our brochures, quoted directly to your or your travel agent either verbally or in writing are in Australian Dollars.  In the case of villa accommodation and some cruise product, where the published price is in US Dollars or other foreign currencies, an Australian Dollar equivalent will be quoted but subject to confirmation at time of payment of deposit and final balance.  Prices are valid for travel during the dates shown only and are inclusive of taxes and charges that apply as at the time of publication.  Prices quoted are subject to change and are only guaranteed once full payment for all services has been received by us from you or your travel agent.  Changes to prices may occur due to matters outside our control which increase the cost of the product or service, such as, but not limited to, currency fluctuations or changes to local taxes.

Booking Terms & Conditions, amendments, cancellations & refunds

For your review prior to proceeding with a new booking, we will provide you or your travel agent with the most up to date amendment and cancellation policies for each service provider on your itinerary specific to the services included (including special offers), prior to monies being received by us.  Please note specific Terms often apply for special offers at most resorts that may differ from their regular published Terms.

A service fee deposit of minimum $150 per person is required within 7 days of written confirmation being sent to you.  This service fee is not refundable in the event you do not travel, though can be credited toward future land packages booked with us for travel by the same travellers within 12 months of the original dates of travel (extendable if border restrictions do not permit international travel).  Some products and private villa accommodation require deposit amounts as high as 50% due immediately on confirmation.  Receipt of the service fee deposit indicates to The Celebration Travel Company that you have read, understood, and agree to the Terms and Conditions provided by us directly to you or your travel agent, and that you agree with the confirmed travel arrangements detailed on your booking confirmation and invoice.  You also understand that by paying a deposit only, your price is subject to change until payment has been received in full by The Celebration Travel Company for travel services arranged by us.

Generally, full and final payment is due no later than 45 days prior to the commencement of travel services provided by us, subject however, to supplier deadlines and conditions.  Some hotels and cruise lines may require final payment earlier than our standard policy in peak travel times, and it is a requirement you pay the full amount by the due date advised at time of booking.  These will be detailed on your booking confirmation and invoice prepared prior to you paying a deposit.

In the event you need to cancel your reservation, the following cancellation Terms will apply (unless specified otherwise per service provider on the Terms provided at time of booking):

  • Up until 45 days prior to the commencement of all travel services arranged by us we will transfer your service fee deposit to future travel services arranged by The Celebration Travel Company for the same travelling party within 12 months of the original date of travel services (extendable if border restrictions do not permit international travel), though charges or fees imposed by service providers may apply as specified in the Terms for each service provider on your itinerary provided to you or your travel agent at time of booking. Prices may differ for future travel compared to prices for your original travel dates.
  • Cancellations within 30 days of commencement of travel services provided by us may incur cancellation fees of up to 100%, or dependent on Terms for each service provider on your itinerary provided at the time of booking, partial or full credit of the value paid per service provider may apply. Seasonal rates and value-added inclusions may differ for future travel compared to your original travel dates.

Any applicable refunds are subject to the terms and conditions of each service provider and will be processed only once we have received funds owing to us from the service providers concerned.  This usually takes a matter of weeks, but in some circumstances, particularly with regard to airlines, can take on average 60-90 days.  We are not responsible for any delays in refunds whilst waiting for funds to be remitted by service providers.  We reserve the right to deduct any international transaction fees incurred by us, or exchange rate variances since time of payment to the service provider, from the applicable refund to you.

NO refunds are issued for any unused services once travel has commenced.

Payments & credit card transactions

Payment can be made by direct deposit or credit card (via our secure on-line portal).  Credit card surcharges will apply when paying by credit card.  Your booking confirmation and invoice provides payment option details, including credit card surcharges.

Payments to The Celebration Travel Company can only be accepted in Australian Dollars.  In the case of villa accommodation and some cruise product, where the published price is in US Dollars or other foreign currencies, an Australian Dollar equivalent will be provided on our invoice with immediate payment required to avoid amendments due to currency fluctuations.

Monies held in Trust

All monies paid to us for your travel services will be held in Trust until such time as payments are required by the relevant service providers.  All service providers are pre-paid by us prior to your date of travel.

Travel Insurance

We strongly recommend that you and all members of your travelling party take out travel insurance to cover the full duration of your travel arrangements, prior to paying a deposit for your booking.  Travel insurance is strongly recommended by the Australian Department of Foreign Affairs and Trade.

Travel documentation, health, passports & visas

You are required to be familiar with the appropriate travel documents required for your holiday, including passport, visa, and health requirements.  You are responsible for all entry, exit, health laws, regulations, orders, demands or visa requirements of countries visited.  You are also responsible for any re-entry visas that may be required.

All members of your party must have a valid passport for international travel with at least six months validity from the date of your return.  You or your travel agent are responsible for providing us with the names of all members of your travelling party as they appear in your passport at time of making your initial booking.  Dates of birth for any travellers under 18 years are also required at that time.

Any fines, penalties, payments or expenditures incurred as a result of your travel documents not meeting the requirements of countries visited, or of residence, will be solely your responsibility.

Force Majeure

We, and our service providers, are not liable for any failure or delay in performing an obligation within the terms of your booking process or travel arrangements that is due to any of the following causes, to the extent beyond  its  reasonable  control:  acts  of  God,  accident,  riots,  war,  terrorist  act, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public  health  crisis, civil  commotion,  breakdown  of  communication  facilities, natural  catastrophes,  governmental  acts  or  omissions,  changes  in  laws  or regulations,  national  strikes,  fire,  explosion,  generalized  lack of availability of raw materials or energy.

For  the  avoidance  of  doubt,  we are not liable for force majeure or any other event which is beyond our control or which is not preventable by us.

In the event of a force majeure, you will be bound by the service providers’ terms and conditions.

Complaints

If you experience any dissatisfaction during your holiday that the hotel, resort, cruise line, or service provider staff cannot directly assist you with, it is important you contact your consultant as quickly as possible to assist in rectifying the matter where possible.
